Commonwealth Edison Condemnation Defeated
Partners Ted Meyers and Craig Mielke successfully defended landowners against unlawful attempts by Commonwealth Edison to condemn their land. Although some landowners may welcome condemnation proceedings as a means to "sell" some of their property, these clients were adamantly opposed to Com Ed building 80 foot tall high voltage lines along their valuable road frontage.
Meyers and Mielke formulated a unique defense strategy and convinced the trial court that Com Ed's attempts to condemn exceeded their lawful authority to do so. As a result, the lawsuit brought by Com Ed in the circuit court of Kane County was dismissed.
However, Meyers and Mielke had not fully vindicated their clients' rights and continued to pursue Com Ed with a petition for attorneys fees and expert witness costs. Com Ed eventually paid a court ordered award of fees and costs thereby saving our clients substantial sums.
