This is a case involving medical malpractice. A lawsuit was filed against the physician in charge of the delivery of Mireya Santellanes as well as the attending nurses and Provena Hospital in Aurora, Illinois. The lawsuit claims that the doctor and nurses failed to timely deliver the child. The child was delivered by the nursing staff at the Hospital without the physician being present. The child was born with severe neurology deficits which resulted in the condition known as cerebral palsy. The case has been partially resolved for payment of $3,000,000.00 by the negligent physician. The case is currently pending against the attending nurses and Hospital. The key point to this case was that we made the decision to file suit in Cook County, Illinois. To our knowledge, no one has brought a similar case in Cook County against Provena Mercy Center Hospital in Aurora, Kane County, Illinois.
